TERMS & CONDITIONS
These Terms & Conditions apply to and form part of every quotation, proposal, estimate, work order, purchase order, variation, invoice and agreement issued by tekDB Pty Ltd unless expressly agreed otherwise in writing. These Terms & Conditions are available at www.tekdb.com.au/terms and a copy will be provided upon request.
All quotations are based upon information provided at the time of pricing, visible and reasonably accessible site conditions, available drawings, specifications and assumptions reasonably made by tekDB. Quotations are valid for thirty (30) days unless otherwise stated. tekDB reserves the right to revise pricing where site conditions, environmental conditions, dimensions, access, substrate condition, moisture levels, structural conditions, weather impacts, project requirements or specifications differ from those originally provided or reasonably anticipated at the time of quotation.
Unless specifically included in writing, quotations exclude works, services or costs associated with structural engineering, design services, demolition, rubbish removal, asbestos or hazardous material removal, external or internal site protection, scaffolding supply, craneage, traffic control, permits, after-hours access costs, substrate rectification, structural rectification, concrete cancer rectification, tiling, painting, joinery, electrical works, plumbing works, hydraulic works, trade coordination, protection by others, ventilation additions or needs, council or strata approvals, certification, and any works outside the specifically nominated scope of works.
A deposit of thirty percent (30%) of the quoted amount is payable within seven (7) days of acceptance unless otherwise agreed in writing. Where works are scheduled to commence within seven (7) days of acceptance, the deposit must be received as cleared funds prior to commencement. Where applicable, deposit amounts shall comply with relevant Queensland legislative requirements, including QBCC requirements where applicable. tekDB reserves the right to request progress payments where works extend over multiple stages or where delays occur outside tekDB’s control.
Accounts unpaid beyond seven (7) days from the due date may incur interest at the rate of 10% per annum calculated daily, together with reasonable administration, legal and debt recovery costs incurred by tekDB in recovering outstanding amounts. tekDB reserves the right to suspend works, refuse further attendance, withhold warranties, certificates or technical documentation, and recover all reasonable costs associated with suspension, delay or remobilisation where payments are overdue.
The Client must ensure the Site is safe, accessible, clean, adequately prepared and ready for commencement on the agreed date. All preceding trades and works required for tekDB to safely and properly undertake its scope must be completed prior to commencement unless otherwise agreed. If the Site is not ready, accessible, weather-protected where required, or in the agreed condition upon arrival, tekDB reserves the right to postpone or reschedule works and charge additional costs associated with delays, standby time, remobilisation, additional labour attendance, plant and equipment downtime, travel or after-hours attendance.
Where delays, interruptions, restricted access or unproductive attendance occur due to matters outside tekDB’s reasonable control, including delays caused by the Client, principal contractors, other trades, overlapping works, restricted access, unsafe conditions, weather events, latent conditions, authority delays, incomplete preceding works, supply shortages or other third-party actions, tekDB reserves the right to recover all reasonable additional costs incurred. Such costs may include, without limitation, additional labour charged at tekDB’s then-current hourly rates, travel, call-out fees, standby time, remobilisation, plant, equipment, materials and any other reasonable costs incurred in completing the Works. All applicable charges are exclusive of GST unless otherwise stated.
